What a notice must contain

For a notice to be effective under the law it must be in writing and include:

What we do

On receiving a notice that meets these requirements we remove or disable access to the material promptly, tell the person who posted it, and give them a copy of the notice. We keep a record of notices.

Counter-notice

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the same agent with: your signature; identification of the material and where it appeared before removal; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; your name, address and telephone number; and a statement that you consent to the jurisdiction of the federal court for your district (or, if outside the United States, for any district in which NXT Move Inc may be found) and will accept service from the person who sent the notice. We forward counter-notices to the original complainant and may restore the material in 10 to 14 business days unless they tell us they have filed a court action.

Repeat infringers

We close the accounts of people who infringe repeatedly.

Misuse

Knowingly misrepresenting that material is infringing, or that it was removed by mistake, is itself unlawful under §512(f). Consider whether a use is fair use or licensed before sending a notice.
